Post-Brexit EU Intellectual Property Rights Update

The UK Government recently announced their intention to convert EU registered designs and trade marks into parallel UK registered designs and trade marks free of charge if and when the UK leave the EU. We await clarity on the arrangements to be applied to pending EU design and trade mark applications (which is shaping up to be a less simple and more costly process) but this is welcome news to brand owners, both home and abroad, as the UK Trade Marks Act already legislates for such “cloning”, which should ensure that the EU can’t veto it and that the government remains true to its word!
